Member Name Game, Inc. (“MNG”) is committed to protecting your privacy. Please read the MNG Online Privacy Statement below.
MNG is only available in the United States and is only sold to businesses within the United States. MNG does not collect information on unregistered visitors to our websites, nor does MNG sell information collected from registered users.
MNG Products and Services are public by nature, specifically in that MNG was created to promote training through some social interaction. Additionally, we collect information when you register and as you use the MNG site; including personal identifiable information and information about how you use the site. By using the MNG Products and Services you consent to the use by MNG of your data, and all other information provided by you as result of use of the MNG Products in accordance with this policy.
This MNG Online Privacy Statement applies to data collected by MNG through its Website (alternatively “Site”) and MNG Products and Services.
Collection of Your Personal Information
When your account is created by your club administrator, a username is created as your personal identifier, along with other information required to become an active user. This information may include your name, home or other address, e-mail address, telephone numbers, test scores or other information that may tell another person about you.
Additionally, in order to access some MNG Products, you may be asked to opt in with an e-mail address, name, and other identifying information and password, which we refer to as your credentials. By signing in on to the MNG Site or Products , you may be automatically signed into other MNG Sites and Products. As part of creating your credentials, you may also be requested to provide questions and secret answers, which we use to help verify your identity and assist in resetting your password, as well as an alternate e-mail address.
Even if you elect not to opt in, we may collect information about your visit, including the pages you view, your test and other actions taken in connection with MNG’s Sites and MNG Products. We also collect certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring Web site addresses.
When you receive newsletters or promotional e-mail from MNG, we may use web beacons (described below), customized links or similar technologies to determine whether the e-mail has been opened and which links you click in order to provide you more focused e-mail communications or other information.
Use of Your Personal Information
To the extent authorized, MNG collects and uses your personal information to operate and improve its Sites and deliver the Products. These uses may include providing you with more effective customer service; publishing your score to a limited number of users, entering your score into contests, enabling full use of the Site’s features, providing information to you at a designated e-mail or IP address in performance of the desired Service and Product, making the Site or Service easier to use by eliminating the need for you to repeatedly enter the same information; performing research and analysis aimed at improving our products, services and technologies; and displaying content and advertising that are customized to your interests and preferences.
We also use your personal information to communicate with you. We may send certain mandatory service communications such as welcome letters, information on technical service issues, and security announcements. Personal information collected on MNG Sites and Products may be stored and processed in the United States or any other country in which MNG or its affiliates, subsidiaries or agents maintain facilities, and by using an MNG Site or MNG Product, you consent to any such transfer of information outside of your country. MNG abides by the safe harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union.
Sharing of Your Personal Information
Except as described in this statement, the service agreement signed by each club, or on the MEMBERNAMEGAME website, we will not disclose, use, sell, transfer or disseminate your personal information outside of MNG and its controlled subsidiaries and affiliates without your consent.
We occasionally hire other companies to provide limited services on our behalf, such as handling the processing and delivery of mailings, providing customer support, hosting websites, processing transactions, or performing statistical analysis of our services. Those companies will be permitted to obtain only the personal information they need to deliver the service. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose.
We may access and/or disclose your personal information if we believe such action is necessary to: (a) comply with the law or legal process served on MNG; (b) protect and defend the rights or property of MNG (including the enforcement of our agreements); or (c) act in urgent circumstances to protect the personal safety of users of MNG services or members of the public.
Accessing Your Personal Information
You may have the ability to view or edit your personal information online. In order to help prevent your personal information from being viewed by others, you will be required to sign in with your credentials (e-mail address, user name and password). The appropriate method(s) for accessing your personal information will depend on which Sites or Services you have used.
You can access and update your profile on membernamegame.com by visiting Account Settings in “My Account”.
Furthermore, if you have registered for the MNG Products, pursuant to the Terms of Use, you have also authorized MNG to use your anonymous and publicly available biographical materials for advertising and promotional purposes.
Protecting Children
We at MNG realize that the use of this Site may not be appropriate for everyone; particularly young children. The website is designed with an audience of 18 years old and above in mind. For this reason, every member registration is asked to confirm that they are at least 18 years of age, and we use best efforts to ensure the enforcement of this minimum age policy.
California Privacy Rights
California Civil Code Section 1798.83 permits users who are California residents to request certain information regarding disclosure of personal information to third parties for their direct marketing purposes. Communication Preferences
You can stop the delivery of future promotional e-mail or use of your information from any MNG Site and MNG Product by following the specific instructions and opting out on the Account Setting page within your club’s portal to MNG.
You can stop delivery of MNG messages and notifications to your personal email address by going to your Account Message & Notification Settings.
Security of Your Personal Information
MNG is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we store the personal information you provide on computer systems with limited access, which are located in controlled facilities. When we transmit highly confidential information over the Internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol.
If a password is used to help protect your accounts and personal information, it is your responsibility to keep your password confidential. Do not share this information with anyone. If you are sharing a computer with anyone you should always choose to log out before leaving a site or service to protect access to your information from subsequent users.
Use of Cookies
MNG Web sites use “cookies” to enable you to sign in to our services and to help personalize your online experience.
Log files, IP addresses and information about your computer
Due to the communications standards on the Internet, when you visit an MNG web site we automatically receive the URL of the site from which you came and the site to which you are going when you leave the Site. We also receive the Internet protocol (IP) address of your computer (or the proxy server you use to access the World Wide Web), your computer operating system and type of web browser you are using, e-mail patterns, as well as the name of your ISP. This information is used to analyze overall trends to help us improve the MNG Products. The linkage between your IP address and your personally identifiable information is not shared with third-parties without your permission or except when required by law.
Controlling “Spam” or Unsolicited E-mail
MNG is concerned about controlling unsolicited commercial e-mail, or “spam.” MNG will not sell, lease or rent its e-mail subscriber lists to third parties.
Disclaimer
It is also possible that we may need to disclose personal information when required by law, such as responses to civil or criminal subpoenas, or other requests by law enforcement personnel. We will disclose such information wherein we have a good-faith belief that it is necessary to comply with a court order, ongoing judicial proceeding, subpoena, or other legal process or request to MNG brought in any country throughout the world, or to exercise our legal rights or defend against legal claims. Additionally, wherein MNG has a good-faith belief that it is necessary to comply with a bona fide request for information from your employer, MNG will disclose information to that party to the extent necessary to comply.

We will occasionally update this privacy statement to reflect changes in our services and customer feedback. When we post changes to this Statement, we will revise the “last updated” date at the bottom of this statement.
